(T&Cs)
§ 1 Scope
These Terms & Conditions (“T&Cs”) of the A STAR IS BORN online shop apply to the ordering of goods from the product range offered in our webshop, including products and services in the “Embroidery” category. Please note that all custom and individually made items, particularly personalized embroidered products, are excluded from the right of return.
§ 2 Conclusion of Contract
By clicking the “Pay” button, you submit a binding offer to purchase the goods in your shopping cart and accept the Terms & Conditions. The automatic order confirmation we send documents that we have received your order but does not yet constitute acceptance of your offer. A contract is concluded only through our separate order confirmation email or by dispatch of the goods. You are required to complete all fields in the order form fully and truthfully.
§ 3 Product Availabilityt
If the goods you ordered are temporarily unavailable at the time of purchase, we will usually inform you within 24 hours. If the goods are permanently unavailable, no contract is concluded, and we will notify you. In the event of a delivery delay of more than two weeks, you have the right to withdraw from the contract. Similarly, we may cancel the contract if we cannot deliver the ordered goods within an additional 7-day period after a delay of more than 14 days. Any payments already made will be refunded promptly.
§ 4 Delivery
We deliver by post as quickly as possible—usually within a few days. Please note that our products are not mass-produced, so delivery times may vary. The shipping costs displayed at checkout are to be borne by you.
§ 5 Payment
All prices on this website are in Euro [EUR] and include the applicable statutory VAT. Packaging and shipping costs are charged separately. You may choose from the payment methods displayed during checkout, e.g., credit card, Maestro, PayPal, or cash on delivery. We reserve the right to limit payment options in individual cases. Entered payment data are not stored by us but may be stored by the respective payment provider.
§ 6 Retention of Title
The delivered goods remain our property until full payment has been received.
§ 7 Right of Withdrawal
If you do not like a delivered item, you may return it within 14 days of receipt. We only accept returns in their original condition: unused, unworn, unwashed, and in the original packaging (if applicable). Cut-to-size items and all custom or individually made products, such as personalized embroidery, are excluded. Return costs are your responsibility. Please ensure the package is sufficiently prepaid. Any credit arising from an accepted return will be refunded promptly.
§ 8 Warranty and Liability
Statutory warranty rules apply. The customer is obliged to report obvious defects immediately upon receipt of the goods.
We are only liable for damages caused by gross negligence or intentional misconduct on our part.
§ 9 Data Protection
We process personal data in accordance with our Privacy Policy, available on our website.
§ 10 Final Provisions
10.1. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2. GThe court of jurisdiction for all disputes arising from or in connection with these T&Cs and the contracts concluded based on them is the Regional Court of Innsbruck if the customer is a consumer. Otherwise, the Regional Court of Innsbruck has jurisdiction.
10.3. Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions remains unaffected.
